- Access RAG (Retrieval-Augmented Generation) capabilities
2.1 Third-Party AI Service Data Sharing
By using our Platform, you acknowledge and agree that your data will be shared with third-party AI service providers to enable core functionality.
Specifically, we share the following data with AI providers (Anthropic Claude, OpenAI, and Google Gemini):
- Your chat messages and conversation content
- Files and images you upload for analysis
- Conversation context and history
- Function parameters and execution requests
Each AI provider has their own privacy policies and data retention practices. You can choose which AI provider to use in your account preferences. For detailed information about how we share data with third-party AI services, including what we never share (API keys, payment information, passwords), please refer to Section 4.1 of our Privacy Policy.
3. User Accounts and Registration
3.1 Account Creation
To access certain features of the Platform, you must create an account. You agree to:

- No Content Monitoring: SigmaDomain does not monitor, review, or filter content created through our Platform
- User Responsibility: You are solely responsible for all content you create, generate, or distribute through our services
- No Safety Guarantees: We do not guarantee that content created through our Platform is safe, appropriate, or free from harmful elements
- Third-Party Content: SigmaDomain is not responsible for offensive, harmful, or inappropriate content created by third-party AI services
- Content Screening: You must screen and evaluate all content before use, distribution, or exposure to others
4.2 Harm and Offensive Content Disclaimer
SigmaDomain expressly disclaims responsibility for:
- Any offensive, harmful, or inappropriate content created through our Platform
- Content that promotes self-harm, suicide, or harm to others
- Discriminatory, violent, or hateful content generated by AI services
- Any emotional, psychological, or physical harm caused by content exposure
- Content that violates community standards or social norms
- Any consequences of using or distributing AI-generated content
5. Function Registration and Execution
5.1 Function Registration
When registering functions in our AI agency database, you agree to:
- Only register functions that you have the right to use
- Provide accurate descriptions and parameters for your functions
- Ensure your functions do not violate any laws or regulations
- Not register malicious or harmful functions
- Comply with all applicable laws and regulations in your jurisdiction
- Not register functions that could cause harm, damage, or violate third-party rights
5.2 Function Execution
You acknowledge and agree that:
- Function execution is performed by AI agents and third-party services
- Results may vary and are not guaranteed to be accurate, complete, or reliable
- You are solely responsible for validating function outputs and their consequences
- We are not liable for any consequences, damages, or losses resulting from function execution
- Function execution may involve third-party APIs, services, or systems beyond our control
- We do not guarantee the availability, security, or performance of any third-party services
5.3 Third-Party AI Agents and Services
You expressly acknowledge and agree that:
- SigmaDomain acts solely as a platform provider and does not create, control, or endorse any third-party AI agents, functions, or services
- All third-party AI agents, functions, and services are provided "as is" without any warranties
- We are not responsible for the accuracy, reliability, safety, or legality of any third-party content, functions, or services
- Your use of third-party AI agents or functions is entirely at your own risk
- We do not verify, validate, or endorse any third-party AI agents, functions, or their outputs
- Any disputes, claims, or issues arising from third-party AI agents or functions must be resolved directly with the third-party provider
6. Intellectual Property Rights
6.1 Platform Content
The Platform and its original content, features, and functionality are owned by Cubic Search, Inc. dba SigmaDomain and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 User Content
You retain ownership of content you create, but grant us a license to:
- Use, store, and process your content to provide our services
- Improve our AI models and services
- Display your content as part of the service
6.3 Function Code
When you register functions, you grant us the right to:
- Execute your functions as part of our AI orchestration
- Store function definitions and metadata
- Use function outputs to improve our services
6.4 AI-Generated Content and IP Infringement
You expressly acknowledge and agree that:
- No IP Guarantees: SigmaDomain does not guarantee that AI-generated content, functions, or outputs are free from intellectual property infringement
- User Responsibility: You are solely responsible for ensuring that any content created, generated, or produced through our Platform does not infringe upon third-party intellectual property rights
- Pre-Use Research Required: You must conduct thorough intellectual property research and clearance before using, distributing, or commercializing any AI-generated content
- No Endorsement: SigmaDomain does not endorse, verify, or validate the intellectual property status of any AI-generated content
- Third-Party IP Claims: You are responsible for all claims, damages, and legal costs arising from intellectual property infringement related to AI-generated content
6.5 Intellectual Property Compliance Obligations
You agree to:
- Conduct IP Research: Perform comprehensive intellectual property searches and clearance before using AI-generated content
- Obtain Licenses: Secure all necessary licenses, permissions, and rights before using AI-generated content commercially
- Monitor for Infringement: Continuously monitor AI-generated content for potential intellectual property violations
- Cease and Desist: Immediately cease using any content that may infringe upon third-party intellectual property rights
- Legal Consultation: Consult with qualified intellectual property attorneys when necessary
- Indemnify SigmaDomain: Defend and indemnify SigmaDomain against all IP-related claims and damages
6.6 Third-Party AI Services and IP
When using third-party AI services through our Platform, you acknowledge that:
- Third-Party Responsibility: Third-party AI service providers are solely responsible for the intellectual property status of their outputs
- No SigmaDomain Liability: SigmaDomain is not liable for any intellectual property infringement committed by third-party AI services
- Direct Resolution: All IP disputes with third-party AI services must be resolved directly with the service provider
- Independent Verification: You must independently verify the intellectual property status of all third-party AI outputs

You acknowledge and agree that:
- Platform IP Ownership: SigmaDomain owns all intellectual property rights in and to the Platform, including but not limited to patents, copyrights, trademarks, trade secrets, and know-how
- Proprietary Processes: Our AI orchestration methods, function registration systems, and platform architecture are proprietary and confidential
- No Reverse Engineering: You may not reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or processes underlying our Platform
- No Competitive Analysis: You may not use our Platform to analyze, study, or understand our proprietary methods, processes, or technologies for competitive purposes
- No Process Copying: You may not copy, imitate, or replicate our AI orchestration processes, function management systems, or platform architecture
- Patent Rights: SigmaDomain reserves all rights to pursue, obtain, and enforce patents related to our AI orchestration technology, platform architecture, and proprietary processes
- Trade Secret Protection: Our proprietary algorithms, processes, and methodologies are trade secrets and confidential information
6.9 User Limitations on Platform Analysis
You expressly agree not to:
- Use our Platform to study, analyze, or understand our proprietary AI orchestration methods
- Attempt to replicate our function registration, execution, or management processes
- Use our Platform to develop competing AI orchestration or function management systems
- Extract, copy, or reproduce our proprietary algorithms, processes, or methodologies
- Use our Platform's outputs to reverse engineer our underlying technology
- Share or disclose our proprietary processes or methodologies with third parties
- Use our Platform for competitive intelligence gathering or analysis
6.10 Permitted Use of Generated Content
While you may use AI-generated content created through our Platform, you acknowledge that:
- Content Use Only: You may use the final AI-generated content for your intended purposes
- No Process Rights: You do not acquire any rights to our underlying processes, methods, or technologies
- No Derivative Rights: You may not claim ownership of or rights to our AI orchestration processes
- Attribution Required: You must acknowledge SigmaDomain as the platform provider when using our services
- No Commercial Exploitation of Process: You may not commercially exploit our proprietary processes or methodologies
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

SigmaDomain may create backups of user data, communications, and account information from time to time for operational, security, and business continuity purposes. You acknowledge and agree that:
- SigmaDomain is not obligated to purge, delete, or remove all sources of your information upon account cancellation or termination

- Backup data may be retained for extended periods for operational, legal, or regulatory compliance purposes
- We are not required to provide confirmation of complete data deletion upon account termination
- Some data may persist in backup systems even after account deletion requests

- Assumption of Risk: You use third-party AI agents, functions, and services entirely at your own risk
- No Endorsement: SigmaDomain does not endorse, verify, or validate any third-party AI agents, functions, or services
- Independent Evaluation: You are solely responsible for evaluating the safety, legality, and appropriateness of any AI agent or function before use
- Compliance: You are responsible for ensuring your use of AI agents and functions complies with all applicable laws and regulations
- Data Protection: You are responsible for protecting your data and ensuring it is not compromised by third-party services
- Function Validation: You must validate and verify all outputs from AI agents and functions before relying on them
- No Reliance: You should not rely solely on AI agent outputs for critical decisions without human verification
Platform Role: SigmaDomain serves solely as a platform provider and intermediary. We do not create, control, or assume responsibility for any AI agents, functions, or their outputs. Our role is limited to providing the technical infrastructure for users to access and interact with third-party AI services.
9. Payment Terms and Financial Arrangements
9.1 Subscription and Service Fees
SigmaDomain may offer subscription services, premium features, or other paid services. By subscribing to or purchasing such services, you agree to:
- Pay all applicable fees and charges in advance
- Provide accurate billing and payment information
- Authorize automatic recurring payments for subscription services
- Pay any applicable taxes, fees, or surcharges
- Accept that fees are non-refundable except as required by law
9.2 Payment Processing and Third-Party Services
You acknowledge and agree that:
- Payments are processed through third-party payment processors
- SigmaDomain is not responsible for payment processing errors or delays
- Payment processing is subject to the terms of third-party payment providers
- We may share payment information with payment processors as necessary
- Failed payments may result in service suspension or termination

- Consequences of function execution or AI recommendations
- Any damages, losses, or injuries resulting from the use of third-party AI agents, functions, or services
- Security breaches, data leaks, or privacy violations caused by third-party services
- Financial losses, legal issues, or regulatory violations arising from third-party function execution
- Any harm, damage, or liability caused by user-registered functions or their execution
- Intellectual property violations, copyright infringement, or other legal issues related to third-party content
- Any consequences of AI agent decisions, recommendations, or actions
- Payment processing errors, delays, or failures
- Disputes with third-party payment processors or financial institutions
- Revenue sharing disputes or financial disagreements with partners
- Tax-related issues or compliance problems
- Billing errors, overcharges, or refund disputes
- Any intellectual property infringement claims arising from AI-generated content
- Copyright, trademark, patent, or trade secret violations in AI outputs
- Claims related to AI training data intellectual property rights
- Disputes over ownership or licensing of AI-generated content
- Legal costs and damages from IP infringement lawsuits
- Cease and desist orders or injunctions related to AI-generated content
- Claims of derivative works or unauthorized use of protected materials
- Any claims arising from disclosure of information to government authorities or law enforcement
- Claims alleging infringement of SigmaDomain's intellectual property rights
- Disputes over ownership of our proprietary processes, methods, or technologies
- Claims that users have rights to our AI orchestration processes or platform architecture
- Allegations of reverse engineering or unauthorized analysis of our proprietary systems
- Claims related to compliance with government requests, subpoenas, or court orders
- Any harm or damages resulting from government access to user data or communications
- Any offensive, harmful, or inappropriate content created through our Platform
- Content that promotes self-harm, suicide, or harm to others
- Discriminatory, violent, or hateful content generated by AI services
- Any emotional, psychological, or physical harm caused by content exposure
- Claims related to content that violates community standards or social norms
- Any consequences of using or distributing AI-generated content
- Harm caused by exposure to offensive or inappropriate materials
Platform Provider Disclaimer: SigmaDomain operates solely as a platform provider and intermediary. We do not create, control, endorse, or assume responsibility for any third-party AI agents, functions, services, or their outputs. All such content and services are provided by independent third parties and are subject to their own terms of service and privacy policies.

The Platform is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the service will be uninterrupted or error-free
- Warranties regarding the accuracy of AI-generated content
- Warranties that defects will be corrected
- Warranties regarding the safety, reliability, or legality of third-party AI agents or functions
- Warranties that third-party services will be available, secure, or perform as expected
- Warranties regarding the accuracy, completeness, or usefulness of function outputs
- Warranties that user-registered functions comply with applicable laws or regulations
- Warranties regarding the security of data processed by third-party services
- Warranties that AI agent recommendations or decisions are appropriate or safe
- Warranties that AI-generated content is free from intellectual property infringement
- Warranties regarding the intellectual property status of AI training data
- Warranties that AI outputs do not violate copyright, trademark, patent, or trade secret rights
- Warranties regarding the ownership or licensing status of AI-generated content
- Warranties that AI services have proper rights to training data or source materials
- Warranties that content created through our Platform is safe, appropriate, or free from harmful elements
- Warranties that AI-generated content will not be offensive, discriminatory, or promote violence
- Warranties that content will not cause emotional, psychological, or physical harm
- Warranties that content complies with community standards or social norms
- Warranties that content is suitable for all audiences or age groups
Third-Party Content Disclaimer: SigmaDomain does not warrant, endorse, guarantee, or assume responsibility for any third-party AI agents, functions, services, content, or information available through the Platform. All such content is provided by independent third parties and is subject to their own terms and conditions.
Intellectual Property Disclaimer: SigmaDomain does not warrant, guarantee, or assume responsibility for the intellectual property status of any AI-generated content, training data, or outputs. We do not verify, validate, or endorse the intellectual property compliance of any AI services, functions, or generated content. Users are solely responsible for conducting all necessary intellectual property research, clearance, and compliance activities before using any AI-generated content.
Content Safety Disclaimer: SigmaDomain does not warrant, guarantee, or assume responsibility for the safety, appropriateness, or harmlessness of any content created, generated, or distributed through our Platform. We do not monitor, filter, or review content for offensive, harmful, or inappropriate elements. Users are solely responsible for screening, evaluating, and ensuring the safety of all content before use, distribution, or exposure to others. We are not liable for any emotional, psychological, or physical harm caused by content exposure.
13. Indemnification
You agree to indemnify, defend, and hold harmless SigmaDomain, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your registration or execution of functions
- Your content or communications
- Your use of third-party AI agents, functions, or services
- Any harm, damage, or liability caused by functions you register or execute
- Any violations of laws or regulations resulting from your use of third-party services
- Any intellectual property violations or copyright infringement related to your functions or content
- Any security breaches, data leaks, or privacy violations caused by your functions
- Any financial losses, legal issues, or regulatory violations arising from your use of the Platform
- Any claims by third parties related to your use of AI agents or functions
- Any intellectual property infringement claims arising from AI-generated content you create, use, or distribute
- Copyright, trademark, patent, or trade secret violations in any AI outputs you utilize
- Claims related to unauthorized use of protected materials through AI services
- Disputes over ownership, licensing, or rights to AI-generated content
- Legal actions alleging derivative works or unauthorized adaptations
- Cease and desist orders or injunctions related to your use of AI-generated content
- Claims of misappropriation of trade secrets or confidential information
- Any failure to conduct proper intellectual property research or clearance
- Any claims arising from SigmaDomain's compliance with government requests or law enforcement demands
- Any attempts to reverse engineer, copy, or replicate our proprietary processes or technologies
- Claims alleging rights to our AI orchestration methods or platform architecture
- Any unauthorized analysis or study of our proprietary systems for competitive purposes
- Disputes over ownership of our intellectual property or trade secrets
- Claims related to disclosure of information to government authorities or regulatory bodies
- Any harm or damages resulting from government access to your data or communications
- Any offensive, harmful, or inappropriate content you create, generate, or distribute
- Content that promotes self-harm, suicide, or harm to others

- Any consequences of using or distributing AI-generated content
- Harm caused by exposure to offensive or inappropriate materials you create or share
Third-Party Claims: You specifically agree to indemnify SigmaDomain against any claims brought by third parties alleging harm, damage, or liability resulting from your use of third-party AI agents, functions, or services, or from functions you have registered or executed through the Platform.
Intellectual Property Indemnification: You specifically agree to indemnify, defend, and hold harmless SigmaDomain against any and all intellectual property infringement claims, including but not limited to copyright, trademark, patent, and trade secret violations, arising from your use of AI-generated content, your failure to conduct proper IP research, or your unauthorized use of protected materials. This includes all legal costs, damages, settlements, and injunctive relief related to such claims.
14. Termination
14.1 Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature.
14.2 Termination by Us
We may terminate or suspend your account immediately if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- You abuse the Platform or its resources
- Required by law or regulation
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of Santa Clara County, California, and you consent to the personal jurisdiction of such courts.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on the Platform. Your continued use of the service after such changes constitutes acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
